I Thomas Joyce of Freshford in the County of Somerset Esquire hereby revoking every other do make publish and declare this to be my last Will and Testament in manner and Form following that is to say I desire that my body shall be interred in the Parish Church of Freshford aforesaid. I give to the Rector and his Churchwardens of the Parish of Freshford aforesaid the Sum of one hundred pounds of Lawful English Money and require that part of my Personal Property hereinafter be given to my Daughter Maria with the payment of the sum upon trust that the Rector and Churchwardens aforesaid so and shall place out the sum of interest on good and proper security for the use and to the intent that the Interest Dividends and Proceeds of the said sum of one hundred pounds shall and may from time to time for which received by them and their respective successors to be by the Rector and Churchwardens aforesaid for the time being given and distributed on the forth day of September in every year to such persons Inhabitants of the Parish of Freshford aforesaid who shall not receive Parochial relief as they the said Rector and Churchwardens for the … bring in all their … shall in their distribution … all my Household Goods, Furniture, Linen, weaving Apparel , Pictures, Books, horses, Cattle, Goats and Carriages except my Coach House and Coach and also all my Implements of Husbandry whatsoever and my Wines and other Liqueurs and also my half of all my Plate the same into two equal parts to be divided I give and bequeath to my Daughter Maria Joyce the wife of my son-in-law John Joyce to her absolute use and benefit charged with the payment of the aforesaid Security of one hundred pounds the other half of my Plate and also my Coach House and Coach I give and bequeath to my Daughter Caroline Evans the wife of my Son in Law The Reverend James Harrington Evans, Clerk for her absolute use and benefit and as for and remaining all that my Manor of Freshford which I purchased of Paul Methuen Esq. With its Rights, Royalties….and Appurtenances and all Mesuages, Tenements, lands and Heridiamernts whatsoever being part and parcel of the said manor situate lying and being in the several Parishes of Freshford, Westwood and Charterhouse Hinton in the Counry of Wilts and Somerset except the Dwelling House, Stable and garden in Freshford aforesaid lately occupied by Mr Waterford and herein offer by disposal of and also as for and receiving all that my Capital Mansion House, gardens, stables, Outhouses and the several Tenements Dwelling Houses, gardens, Closes, Pieces and parcels of land and Heridiaments thereto belonging which I purchased of George Hayward Tugwell Esquire, except a Close of land called Coombe Bottom, Orchard held under the Prebendary of Bristol and also for and remaining all other my Messuages, tenements, lands and Heridiaments situated lying and being in the Parishes of Freshford and Charterhouse Hinton or either of them with their and every of their rights, Members and Appurtenances except the Mill and Factory and Garden in the same parishes hereinafter devised upon ...and other Trusts and hereinafter mentions and also for and containing those two Cottages and Gardens situate at a place called Coombe Bottom in the Parish of Bradford in the County of Wilts. Now occupied by James Neal and John Barrett. I give devise and bequeath the same respective premises except as before excepted unto the said James Harrington Evans, John Joyce and my Nephew Thomas Joyce. Of Freshford aforesaid Clothiers their heirs ans Asigns Subject to and … with the payment of the several Annuities or Yearly Sums and Royalties hereinafter by me given and … and … to lives the same respective portions except as before excepted unto the said James Harrington Evans, John Joyce and Thomas Joyce Their Heirs and Assigns subject and charged as aforesaid to be used upon the Trusts and to and for the intents and puposes hereinafter expressed and ..land of and … the sum that is to say to the use of the said James Harrington Evans, John Joyce and thomas Joyce and their heirs for the term of ninety nine years.to be from the Day of my decease and fully to be completed and if my said Daughter Francis Maria Joyce shall so long live upon Trust … so many years of the said Term and my said daughter Maria shall ..to pay the rents and Profits of the said manor, Messuages, lands, Heridiaments to and ...to the said Maria Joyce to such person or Persons as she shall from time to time notwithstanding her present or any future Covertute by writing under her hand direct and appoint and to as the same shall not be subject or liable to the Control unto in engagements of her present or any future husband and I will and ordain that the .. Or receipts of the said Maria Joyce or such person or persons as she shall from time to time appoint to receive the same shall ..understanding her present or any future … be sufficient discharged to my said Trustees for any such payment and from and immediately after the decease of my said Daughter Maria if she shall not survive to the age of my son in law john Joyce if he shall be then living and his Assignees for the term of ninety nine years to be computed from the day of the Decease of my said Daughter Maria or if she shall die before me then from the day of my decease and fully to be complete and ended if the said John Joyce shall so long live and from and after the end and expiration or other sooner determination of the same term and in the mean time subject there to the use of the said James Harrington Evans, John Joyce and Thomas Joyce. and their heirs being the life of the said john Joyce in Trust …..the uses and estates hereinafter limited from being … and for that purpose to make ...ands being ..ious as ...shall be and require ...none the less to permit and suffer the said John Joyce or his assignees to reserve and take the rents and profits of the said manors, Messuages, tenements, Farms, lands, heridiaments and ...for his or their own use during his life and from and immediately after the decease of my said daughter Maria and son in Law John Joyce to the use of my Grandson Thomas Joyce if he shall be then living d his assignees for and during the term of ninety nine years to be computed from the day of the decease of the last Survivor of my said daughter Maria my said Son in Law John Joyce and myself and fully to be complete and if my said grandson Thomas Joyce would so long live and from and after the said expiration or other ...determination of the said last mentioned .. For his and their own use during the natural life and from and immediately after the decease of the last Survivor of my said daughter Maria, the said John Joyce and my said Grandson Thomas Joyce to the use of the first son of my said grandson Thomas Joyce lawfully to begotten and the heirs male of the body of such first son lawfully issues and for default of such I put top the use of the second, third , forth fifth and all and every other Son and sons of my said Grandson Thomas Joyce lawfully to begotten severally successively and in remainder one after another as they shall severally be in priority of Birth and his Heirs make of the body and bodies of all and every such Son and sons lawfully Issued The Elder of such sons and their heirs make of his body ssues being always preferred and to take before younger of such sons and their heirs make of his body issuing and for want or in default of such Issue to the use of the second Son of the body of my Daughter Maria by her present or any future husband lawfully to begotten and the heirs Make of the body of such second son lawfully issuing and in default of such Issue to the use of their third forth fifth and all and every other the son and sons of the body of my said daughter Maria lawfully to begotten severally successively and in remainder one after another in order and course as they and every of them shall be in priority of birth and of the several and respective heirs made of the body and bodies of all and every such son and sons lawfully issuing the elder of such sons and their heirs made of his body issuing being always preferred and to take before a younger of such sons and the heirs made of his body issuing and for want or in default of such issue to the use of the first daughter of the body of my said Grandson Thomas Joyce lawfully to begotten and their heirs Male of the body of such first Daughter lawfully issuing and in default of such issue to the use of the second third fourth fifth and all and every other the Daughter and Daughters of the body of my said Grandson Thomas Joyce lawfully to be begotten severally successively and in remainder one after another and in order and ...as they and every of them shall be in priority of birth and of the several and respective heirs male of the body and bodies of all and every such daughter and daughters lawfully issuing the elder of such daughters and the heirs male of her body issuing being always preferred and to take before a younger of such daughter and the heirs of her body issuing and in default of such issue to the use of the first daughter of the body of the said Maria Joyce lawfully to begotten and the heirs male of the body of the such first daughter lawfully issued and in default of such Issue to the use of the second third fourth and fifth and all and every other the Daughter and Daughters of the body of the said Maria Joyce lawfully to begotten severally successively and in remainder one after another and in order and ..as they and every of them shall be in priority of Birth and of the several and respective heirs male of the body and bodies of all and every such Daughter and daughters lawfully issuing the Elder of such Daughters and the heirs Male of their body issuing being always preferred and to take before a younger of such Daughters and the heirs Male of her body issuing and in default of such issue to the use of my said Grandson Thomas Joyce and of all and every other the Son and Sons of the body of the said Maria Joyce lawfully begotten or to be begotten severally successively and in remainder one after another in order and course as they and every of them shall be in priority of birth and of the several and respective heirs of the body and bodies of all and every such son and sons lawfully issuing the Elder of such sons and the heirs of his body issuing being always preferred and to take before a younger of such seconds third fourth fifth and all and every other the daughter and daughters of the body of the said Caroline Evans. lawfully begotten or to be begotten severally successively and in remainder one after another in order and course as they and every of them shall be in priority of birth and of the several and respective heirs Male of the body and bodies of all and every such Daughter and daughters lawfully issuing the Elder of such Daughters and the heirs ……………………………………………………………………………………………… I give and bequeath to my sister Mary Hart an Annuity or yearly sum of thirty pounds for her life. To my brother Richard Joyce an Annuity or yearly sum of thirty pounds for his life, to my servant Thomas Warton otherwise Wiltshire if living in my service at the time of my death an annuity or yearly sum of five pounds for his life All which paid annuities or yearly Sums I direct shall commence from the day of my death and be paid by four equal Quarterly paymets to begin and be made at the end of 6 calendar months next after my decease I give to my servant Ann Heals otherwise Wiltshire as a reward for her faithful service during my long illness an annuity or yearly sum of twenty six pounds ten shillings. during her life To my old servant James Neate if living in my service at the time of my death for his faithful service an annuity or yearly sum of twenty pounds during his life both which said annuities or yearly sums shall be paid by 4 equal quarterly payments……………………. I give to my servant Elizabeth watts if in my service at my decease the sum of Ten pounds to be paid to her at the end of 6 months next after my death. To my Brother and sister the sum of five pounds for mourning to be paid to them respectively out of the rents of my Manor and heridiaments into first received after my death and it is my will and I do hereby order and direct that my said Servant Ann Heals shall be permitted to stay and enjoy the Cottage and garden situate at Freshford aforesaid now in her own occupation for and during her life If and for so long time she shall think proper to reside therein but no matter she shall be at liberty to set or set the same And as for all that my Dwelling house, garden, stable and properties in Freshford aforesaid lately occupied by Mr Wakeford and all that Close of land called Coombe Bottom Orchard and all my Fffmants and Copyholds Messuages tenements lands Heridiamewnts and premises situate lying and being at Anclift (Avoncliffe)otherwise Ankley and elsewhere within the Parish of Westwood aforesaid not being part or parcel of my Manor of Freshford aforesaid and all my Copyhold and other Messuages lands Heridts and properties situated in the parish of Bradford in the County of Wilts except the two cottages and gardens herein before mentioned to be situate at Coombe Bottom aforesaid in the occupation of the said James Neat and John Barrett and as for and remaining all that my Glebe Estate held under the Dean and Chapter of Bristol with the Tithes of Wood and all messuages tenements Lands and Herediatements unto there belonging in the Parish of Limpley Stoke in the County of Wilts and also all my freehold Messuages, lands, Heredtaments … in the said parish of Limpley Stoke aforesaid and also as for and remaining all that my freehold and Leasehold Mill and Factory called Dunkirk with the Gardens thereunto adjoining and belonging situate in the Parishes of Freshford and Charterhouse Hinton aforesaid and all that leasehold Mill and factory and premises called Littleton Mill in the Parish of Wellow in the county of Somerset and also for and remaining the Sum of £12,000 due to me from Messrs. Edward and George Coopers and all the rest and residue of my Estate d Effects both real and Personal of what kind .. And whatsoever and all lands Tenements heridiaments whatsoever which has been conveyed or vested ion me by way of mortgage Security and all my estate right tithe and interest of in and to such … premises I give devise and bequest all and singular the same respective ffefments, copyhold, Leasehold and other properties both real and personal and my part and parcel thereof subject to the payment of my Debts funeral and Testamentary Expenses unto … the use of the said James Harrington Evans, John Joyce and my nephew Thomas Joyce their heirs executors administrators and assignees according to the several and qualities of the same … respectively upon the Trusts and to and for the intents and purposes and under and subject to the promises and provisions hereunto after ..
